68 in a 45
« on: April 16, 2012, 11:14:04 AM »
Got nailed Friday the 13th. He was sitting on the side of the road and I never saw him as I came into town. Four lane road and I wasn't passing anyone, the speed cut down from 65 to 55 to 45. I just forgot to slow down. He never asked for anything, He hardly spoke to me, didn't ask where I was going, what the hurry was or anything. Don't blame him though, my own fault.

Kind of hurts because I have a CDL, ticket free for more than 10 years. $281 fine...Thinking about hiring a lawyer..not to fight it just to see if it can be reduced.

If he clocked you at 68, it means your speedometer was registering over 70, which is consider reckless driving where I come from. Don't know about hiring a lawyer, as his/her cost will likely outweigh is savings realized from getting the overage reduced.

My speedo read 70 and the highway reduced from 65 to 55 to 45. I was not blowing by traffic if I was going 68 there must of been cars going 60-65, I just happened to be the one he pointed the gun at. 23 over is not considered reckless driving here 30 over is and requires a court visit.

Mostly concerned because with the CDL I cant take a class to forgive the points, plus have to notify my employer. I am a school teacher who got the CDL out of the goodness of my heart. Budget cuts made it impossible for students to go on field trips and/or sporting events so I vlounteeer to drive them (school bus) on my spare time. I guess I can give back the CDL and not drive the students anymore.

My last ticket (7 year ago now) was 76 in a 45 ( was on my 97 Valk BTW) and $400 and 6 points. I went to the hearing and the ADA looked at my record (no tickets in more then 10 years) and said how about $100 and 3 points? I said sold! If you have a good record and do nothing else, take the time to go to the hearing, well worth it.

Don't hire a lawyer just go in and take your beating. The judge will reduce it.

With a good record, and possibly some persuasive efforts, you likely can get it swapped to some sort of non-moving violation with the same fine.  Or maybe they'll offer traffic school as an option to keep it off of your record?

Sounds like you have goodness in your heart...just made a mistake, perhaps the judge will be lenient once he/she becomes aware of the situation (65 to 45 sounds rather drastic) and learns your story.

+1 on both of these...

My wife got a ticket a couple years ago, it was her first in a really long time. She went into court and the judge said if she did the on-line traffic course it wouldn't go on her record. The nice part was by doing it on-line she didn't even have to go in to an actual classroom, the on-line course was a couple hours long, the cost to take the on-line course was a couple hundred bucks (about the same as if she just paid the ticket and be done) but the good thing was it didn't go on her record...

If you can make the time to show up in court, do so.  Reductions are common, even if the judge doesn't reduce it to a non-moving violation, less points/lower fine is always good.

Not knowing how it works in that particular jurisdiction, I've seen tickets handled different ways.  Some places you'll meet with the DA or police officer before going before the judge, and they'll make an offer of a lesser charge.  Then you just go before the judge for them to approve it.  Other places, you're standing in front of the judge when the DA makes the offer.  If you get to meet with the DA or officer before it, you'll probably have a chance to tell them the reason for your CDL.

I got a 70+ in a 35 zone... BTDT.  I was able to get Deferred Judication (Defensive Driving and clean record for 6 months), but that was before CHL's were in the mix.

Good luck!

That's why CDLs are a bad idea for me. I need tickets fixed.

Just a quick note because I don't want to hi-jack the thread but with the Pilot GT on the front my speedometer reads the same as the radar signs that I pass.

The C14's speedo doesn't care what size front tire you run. The speedo has nothing to do with the front.

Ah, but Pilot GT's are not a C14 tire.  Bet he has a C10, and IIRC, C10 speedos are driven off the front.

I don’t know about Fla. But you might check to see if you can have the ticket deferred. You would just have to continue being good for a while. If deferred, it won't show up.

Say WHAT?  In my area I'm in danger of getting rear ended if I go below 70!
