Buy a new fixture.

I know it requires blowing the wall apart, but it won't fail for another 20 something years.

Look at the old and new cartridges and verify that you actually got the (cold) cartridge. Sounds like you may have a (hot) cartridge.
Look at the mounting tabs (where the cartridge goes into the faucet housing) and verify that the tabs place the do-hicky (that stops the water) in the correct position.
If everything checks out, it's either the cartridge or seal that's leaking
Oh, also verify that the seal spring is at least as ling as the old original.

thank you for the replys, the tabs are aligned and to be honest I am trying to see how the cartridge could stop flow the end has a hole the seal has a hole the body has a hole so at no point is the water not passing through a hole?

The Delta's and peerless cartridge faucets that I've worked with have a solid (no hole in the middle) tab on one side of the cartridge that stops the water flow through the middle of the seal.
I can see the tab in your picture but can't tell if there is a hole in the tab. That tab is the way the cartridge stops the flow of water through the rubber seal.

Does that whole white cartridge thing rotate inside the fixture?  If so, it looks like that metal tab is supposed to cover/uncover the hole in the fixture to control water flow when the handle is rotated.  And the black rubber seal thing must ride on the bottom of the metal tab.  If so, then I'd suspect poor fit, too short, or bad rubber seal, or lack of spring tension/preload.  If that whole thing does NOT rotate, then I'm stumped.
