There I was just got my FIRST tank of gas 157 miles on the odometer, stopped at a red light. I hear squealing tires look down in the mirror to see red and bam to the ground me and the new bike go.....GRRR. Could have been worse and I am only bruised but dang brand new bike. He says my brakes arent working very well, I say no DUH ( not in those words...

Look on the bright side, that spud gun is totaled, insurance should cover the cost of a full AreaP and this would be the perfect opportunity to increase performance with a Neutron Silver paint upgrade ;D

Glad you are OK, I do hope you went to the ER to get checked out, pain has a way of waiting a day before she lets you in on her secret.

So sorry to see you got hit. Just a couple hours ago I was showing my wife the nice color of your new bike. Just checked in again and holy crap. I'd (I can't write all this. Lets just use the word censored!!!!) Good luck with the fix. Glad you walked away to see another day. Have them fix it to original and do the farkling as planned. That way when you buy your 2014 C-14 you can put all the OEM parts back on it when you sell it.

jqram35, First and foremost glad that you are here to tell us how minor your physical injuries are.   This could have been deadly and life changing for a lot of people.  It brings up something that I think about every time I stop, scanning the mirrors until at least two cars are stopped behind me.  When we get a new rider at work and he is in training I harp on possible left turns in front of him and cages coming from the rear.  Thanks for reminding us and good luck on your health and repairs.

Very true and I was not paying attention to that, was thinking about not losing the person I was following. But I would have had no where to go, cars were already in the intersection in front of me...

First off, I am glad you are well enough to tell us about the idiot cager.  Second, which exhaust did you order?  The stock exhaust (slip-on) runs about $900 so that should buy you whichever slip-on or full exhaust that you desire.  Choose wisely......  ;D

My adjuster used OEM prices from the dealer, hopefully your's does the same thing and you will get a nice check to cover the damages and then some.   ;)

I gotcha, being T Boned is a very bad thing...We have a training course called the 90 degree pullout, basically 90 degree right turn from stopped position but in a panic situation application may be iffy.  Again, glad you are here to tell us about the ordeal.   I am sure that beauty will be better than new!

Yeah I practice that as well but there was just no time...Will be paying better attention. First incident in about 60K miles so I haven't been doing to bad on the scooters. I am just glad I was lucky today! Bike will good as new soon. No worries.

Glad you're ok. I think I would have the dealer check the hub and drive line thoroughly for cracks/dammage, just assuming he smacked your rear tire with some force.

Actually there was no mark on the rear tire. I believe the Exhaust took the hit, that factory trash can sized muffler sticks out like a foot LOL. Muffler hanger is bent a bit. Dealer will check her out for sure. Rode her home 60 miles. No unusual noises.

your in pain ,  get a lawyer!!    bring you bike to the kawa shop so they can estimate damage, dont let his insurance adjuster dictate to you what it will cost.    he will try to get you suckered in quick with a check in his hand dont do it.     you got knocked to the ground and are bruised up!!     be smart.

I love it when they say their brakes don't work well, and yet you heard squealing tires. Sounds like they work okay, he just didn't put them on in time then stomped on them. Idiot. I'm sorry to hear about your new bike, but I'm really glad you're okay.

Think I did have the brakes on.

Very smart.  You might have avoided a real disaster by doing this and its something I'll remember to do as well.

Glad to hear yours was fairly minor.

My first C14 was on day two with less than 200 miles, when an un-insured un-licensed driver crossed the centerline into me. Ripped the left side of the bike apart, front to back. Put me in hospital, and bike was a total.

This incident clearly illustrates how important is to have tip over protection on a bike like this.  A set of McEnterprise bars would have  minimized the damage.

Glad you came out of this unscathed. People simply do not pay attention while driving.  I bet whoever hit you did not have a problem with the brakes, but with the cellphone (texting).

Wearing a bright yellow vest over your jacket also greatly increases your visibility.

I installed the side case McEnterprise bars on mine, but did not like the look of the front bars (too bulky) so I did not install them.    Now that I think about it, they provide the best protection for the bike, as they also protect the mirrors which the sliders do not.  So I just might install them and see how it goes.

Very sorry to hear about your new ride being banged up already - that would make me sick to my stomach. I am very glad to hear you could still ride the bike and were not transported from the scene via ambulance. This is a good example of why bikes are dangerous, you don't need to do anything wrong and you can still end up on the wrong side of a car's bumper. Good luck with getting her back to new.

You only had the bike 5 days and only 157 miles on it?  Slacker!   ;)   Glad you are ok and the bike was just scratched up.  Hopefully that's all the damage but it doesn't take much of a knock to twist things under the plastic.  Check it out good.  Always plan an escape route when stopped if you can and always always keep an eye out on vehicles behind you.  That's one of my biggest fears is getting hit by another vehicle whilst stopped at an intersection.

Glad it wasn't worse. Last year I got rear-ended in my car with enough force to push the trunk into the back seat and the front end under the truck in front of me. I often thing about how many pieces I'd be in if I had been on my Connie.

As an insurance guy, I would suggest that you go first party for your damages, assuming you have collision coverage. Your insurance company should respond faster and more willingly than going thrid party directly to the other vehicle's carrier.

You could have a Kawi dealer look at it first, but that probably won't do much good. An appraisor will use his software to arrive at an estimate, and then the shop, wherever you take it, will confer with the appraisor if it looks like any supplements will be needed.

Not for nothing, but contusions and strains/sprains are worth money, dude.  There's a process, and of course, I'm not suggesting you manufacture a disability, but if in fact you are hurting, you deserve compensation for pain and suffering, assuming you actually treat for your injuries.

I am dead sure whoever said the guy was texting is correct, and it pisses me off when I see people doing that. Let them pay for their stupidity.

Glad to hear you were wearing protective gear - and this is an opportunity to emphasis that fact. Even though your accident appears to have been minor, you likely would have suffered more injuries had it not been for the helmet, jacket, shoes, etc. It irks me to death when I see bikers in tennis shoes and shorts - even worse when the driver has protective gear and his passenger is bearly clothed.

As someone suggested in a earlier post, I suggest you see a doctor and consult an attorney. You really don't know the extent of your injuries, afterall you were hit by a 4K lbs vehicle.  Regarding the attorney, I have had too many near misses by inattentive drivers and I think they should pay if they hit someone.

Just for fun, document your brusies. Take photos with a copy of today's newspaper showing the date, next to your knees. Much better would be to go to the hospital, where you will get an actual exam and diagnosis.

The hospital or your PCP will likely provide some medications for pain and refer you to a physical therapist or chiropractor.

Here is your chance, if nothing else, to get treatment for your sore back at the cost of the negligent party. If you are so inclined, you could treat for three or four months, and with little more effort than hiring an attorney and giving him a third of any settlement, you could easily wind up with anywhere from five to ten thousand dollars in your pocket. And possible an improved back. You could even pursue a bodily injury claim by yourself, no lawyer needed, and perhaps do better.

I'm not advocating advancing a fraudulent claim, but bruises are contusions and can't be faked.

I work as a fraud investigator in an insurance company's Special Investigative Unit. I handle cases where people are getting settlements for accidents in which there are NO physical damages and NO visible or objective injuries. Why? Because there is virtually no way to prove that someone did not sustain a soft tissue injury in a motor vehicle collision.

I understand your reluctance to make a big deal out of this incident, and your aversion to lawyers, but the system is in place to compensate you for an event that was none of your making and to penalize the party whose negligence caused you harm. Use it!

It's just a difference in prespective, I suppose. Frivolous injury claims DO contribute to the litigious mess we see today. If the OP doesn't believe he's been inconvenienced in any way, then he is right to get his bike fixed and move on.

Glad you're OK! I cringe thinking about that same situation and being on a bike!

I was hit last year by a woman that they believe was messing with her phone. It was my everyday route home, but thankfully that day I was in my truck! She hit me so hard that it forced me into the car in front of me, then after bouncing off of me, she hit the gas again instead of the brakes and slamed me again!! The second hit forced me into the car in front of me again! They estimate she was doing somewhere around 45mph since there is no eveidence that she even hit her brakes and the amount of damage. 

There's no way I would have make it through that if I was on my bike!!!

I was in the EXACT scenario a few years back on my new Silver C14 ABS. A guy tried to run the red light I was sitting at and tried to swerve around me to get through. All I knew was that one moment I was sitting at the light watching traffic and the next moment I was sliding down the road ahead of my bike watching it tumble in the road and parts going everywhere.

My left wrist was broken (I assume from having the clutch pulled in) and my hands were scuffed (gloves were in the tankbag) and my shoes were knocked off I guess from hitting the pavement. The bike was eventually totalled. Thankfully another motorist got the vehicle description for me. It was a hit and run...they never found the guy.  >:(

I'm very glad that your's didn't end up like mine. Get that thing fixed up and enjoy every minute of it!  8)

I tend to agree but I would have been a bit more PC in my comment  ;D I'm sure there is a time and place for lawsuits, just don't think this is one of those occasions...Now if it turns out his insurance was bogus then it will be on like Donkey Kong!

I hear squealing tires look down in the mirror to see red and bam to the ground me and the new bike go.....GRRR. Could have been worse and I am only bruised but dang brand new bike. He says my brakes arent working very well, I say no DUH ( not in those words...

OMG, I am so sorry to hear about that and I am glad you are OK.  It could so easily be SO much worse.  That REALLY SUCKS to only have the bike for such a short time and wham. 

When sitting at lights, I am always scared someone will rear end me, so I watch for someone coming, then trigger my brake lights so they are more visible (or I let go and then press again so they will flash).  In any case, the very first improvement I make to a bike is more and larger brake lights.

Install the Whelen Police LED strobe lights in red lens next to your tag..and almost eliminate this problem from ever happening again.....they are in constant flashing motion and you can see them a half a mile away....

Don't think Hyperlites are annoying, the Whelen on the other hand is likely illegal is several states and may be annoying. I really don't concern myself too much with annoying after being run over :banghead:....Hyperlites are cheaper and are better looking the Admore light bar IMHO.

I got tapped on the Bazooka about 3 blocks from the shop after getting new PR2’s installed. I got scooted about 2 feet and didn't have any cars in front of me. I wasn’t hurt, bike didn’t fall over but the soccer mom in her Dodge van had wide open eyes.  :yikes: I think she got more damage than I did as her front bumper was scratched, my Bazooka wasn’t. I was more worried about the header pipes but no damage there either. I was stopped at a stop light and on level ground. I don't remember if I was on a brake or not. I don't think it would have made a difference in this case.

I'm glad you are alright and hope the cops wrote the other driver a ticket.  Oh and red is the fastest color.....

I would check that exhaust system really carefully - the pipe sticks out behind the license plate and it was evidently hit by that car's bumper.  Which means the whole exhaust could be bent.

The muffler bracket is bent I dont see any other damage. Bolts on the head look good see no cracks. But it will go to the dealer for inspection. Sux cause new pipe is here and I cant install...

In ALL SERIOUSNESS this post really makes me consider the rear view camera with a small monitor, I know the bike has mirrors, but keeping your eyes in the center of your field of vision has it's advantages! Here in south fl i see many of snowbirds who can barely see over the wheel of their Mercedes...when i'm sitting at a red light it would be an advantage...on a fast road pushin your buddies I do agree it could be a distraction..but i usually didn't worry about them until they were beside me.

Well you can do lots of things and still get hit. I will put on some hyperlites and call it a day. I can tell you from riding behind another bike that has them they do get your attention and I never had any close calls on my FJR with them installed in 33K miles. Sometimes stuff just happens. I still think even if I had seen this coming I would have had no real good options.

That's why I quit staring at the rear-views at stop signs and traffic lights. You really can't tell if the guy behind you is going to stop in time or not, unless he is truly barreling-ass at you, and by then it's probably too late. Not to mention that the guy behind him may be the one to start the chain. All you can do is leave plenty of room between you and the car in front of you, stay to one side of it, and keep your normal scan going.

The one place where I pay more attention to my six is at merges to rotary's and on-ramps. This is where the guy behind you is always looking to his left while moving forward. If I can help it, I do not stop at these places at all, but just do my best to keep rolling. By the same token, when I am stopped behind someone at these intersections, I always wait until I SEE the guy in front of me has merged into the main traffic. It may cost me an opportunity to get out, but it's better to be sure it's clear in front of me before I hit the gas.

Having been hit from behind 2 1/2 times (the half was when the lady decided she REALLY didn't want to hit me, jumped the curb and landed on the sidewalk.  Thank you, Ma'am), I would offer that there are some things we can do to help.

In the car, I stopped quickly for a yellow light, and a small pickup was hoping to make the yellow, and didn't have either the brakes or the reactions to stop in time.  Lesson:  always check the mirrors as part of the stopping process, especially on the bike.

On the bike, I was hit just as the light turned green.  I didn't even know I had been hit, but the pickup's under-bumper plastic got caught up on the rear tire.  I stopped to see why the bike wasn't accelerating properly, and  found I had a truck attached.  Lesson:  watch my six.  I could have easily flashed the brake lights and/or scooted up a bit to avoid the collision.  If stopped in traffic, I stop towards the edge of the lane so I can split the cars if needed.  I watch the mirrors and flash the brake lights a couple of times as the next vehicle approaches the braking zone.

You can't prepare for or prevent every possibility, but there are a lot of things you can to to improve your odds.

The offenders insurance is unable to contacted the insured party to confirm the driver, who was not listed on the insurance, had consent to drive the car.....The owner of the car is sounding more and more like an illegal alien. What a bunch of crap. They say if they are unable to contact the vehicle owner they may not pay the claim, as he may have sold the vehicle or it was stolen or god knows what. Maddening it is! Mean while my bike is still not fixed.

It has been a long time since I worked for an insurance company, but IIRC, the coverage in on the vehicle, but priced on the driver.  Contact your insurance company to verify.  This really s/n/b an issue.

Wow, that does not sound right at all.  I'll remember that if I ever hit someone.  I'll just quit answering the phone when my caller ID says it's my insurance company so they don't have to pay the claim.   I'd inform the insurance company that they can pay the claim with or without attorneys and lawsuits involved, their call and they have one week to pay the claim or the next call will be from an attorney representing you.

Exactly.  I am pretty sure if I were in an accident and the other insurance company was not timely, my State Farm would pay and then go after the offender and/or insurance company.  You should not have to wait weeks for a resolution so that repairs can start.  I am not sure what is "reasonable", but to me, anything more than maybe 10 days is crazy.

Insurance follows the car, not the operator or owner. Even if it was stolen. The only difference is that the owner would not be penalized (surcharged, points, premium hike) if he was able to prove the vehicle was stolen when the accident occurred. However, if the car was not insured, then you most definitely are SOL. Things like unlisted operators, unlicensed operators, unauthorized operators - those all go towards affecting first party claims. You have a valid third party claim and all the aforementioned do not give the insurance company an out from coverage (if they actually insure the vehicle).

As for your property damage, if you have your own coverage, you should definitely go to your own carrier, that's what they are there for. They will subrogate to the other carrier.

These things you say are what I thought too. But that rep told me different. We shall see.

In VA you also have Uninsured Motorist Coverage, it will cover claims as a last resort.

Quite annoyed by the lack of progress by the other parties insurance company, my investigative skills and I went to Slidell today and tracked down the driver and the owner, where they work (together) and provided phone numbers and an address to the insurance. The car was even parked outside in the parking lot. The insurance says they spoke to the owner now and are waiting to speak with the the driver tomorrow, he was not at work today. Originally they told me they only needed to speak with the owner. So why they have changed their mind now is beyond me. If they force me to hire a lawyer I doubt it will work out in their favor...getting tired of the run around... :banghead:

If you have a friend/brother/relative who is an attorney, have them write the insurance company on his letterhead suggesting that it would be expedient to settle your claim forthwith. They often do need a little push, and having a lawyer involved adds workload that the adjustor would rather not have to deal with.

It's not bluffing, it's just an incremental step towards a resolution. In dealing with insurance adjustors, the squeaky wheel definitely gets the grease. They are so busy, dealing with so many people, that it's often just a shuffling game...with the easy claimants getting pushed back so the adjustors can deal with the noisemakers. Trust me, I know what I'm talking about.
